Physical Custody vs Legal Custody
Parents have two types of custody of their children, physical custody and legal custody. The question of physical custody versus legal custody is one that we are asked daily.
Physical custody is who takes care of the child on a daily basis, where is the child sleeping, where are their clothes kept. Physical custody is usually granted to both parents on a Joint Physical custody basis because most parents have some time with the children, even if it is only a few days a week.
Legal custody is the right to know your child’s school performance, and what medical care they are receiving along with the legal right to having your child with you when you travel.
